Terms and conditions

These terms apply to reservations, tastings and gift vouchers at Ora Coffee Salon.

§ 1 Scope and contracting party

The contracting party is Ora Coffee Salon — Mirjam Osterkamp e. K., Eppendorfer Landstraße 87, 20249 Hamburg.

These terms apply to consumers within the meaning of § 13 BGB and to traders within the meaning of § 14 BGB. Differing terms are not recognised unless we have expressly agreed to them in writing.

§ 2 Reservations

Submitting the reservation form is a request, not yet a booking. A contract comes into being only with our confirmation in text form, usually within one working day.

Reserved seats are held for fifteen minutes beyond the agreed time, after which they may be given to others.

Seats at the bar without a tasting need no reservation; free stools are given out in order of arrival.

§ 3 Tastings and omakase

The cupping flight and the coffee omakase take place at fixed times and begin together. Please arrive at least five minutes beforehand; later arrival may mean limited participation or none at all, without a claim to a refund.

The omakase may be cancelled free of charge up to 48 hours before the date. After that, or in the event of no-show, we charge a flat fee of €20 per person. You are free to show that the actual loss was lower.

We choose the lots on the day of the tasting. There is no claim to a particular lot; we take preferences into account while stocks last.

§ 4 Gift vouchers

Vouchers are issued either for an amount or for a service and are valid for three years from the end of the year of issue.

Vouchers are transferable but cannot be paid out in cash and cannot be combined with other reductions. Any remaining balance stays on the voucher.

If a voucher is lost we replace it only where it can be clearly matched to our issue register and has not yet been redeemed.

§ 5 Prices and payment

All prices are in euro and include statutory VAT and service.

The salon is cash-free. We accept common debit and credit cards and mobile payment. Vouchers are invoiced and handed over or posted once payment has been received.

§ 6 Availability of lots

We buy very small quantities and pour each lot only while it lasts. Statements on the card and on the farm pages reflect the position at the time of publication and are not a guarantee of continued availability.

§ 7 House rules

The salon has eleven seats and no tables. Working on a laptop is not possible; there is neither wifi nor power at the bar. Dogs are welcome on a lead, children in the company of an adult.

We reserve the right to exercise our right of domicile where the business or other guests are significantly disturbed.

§ 8 Liability

We are liable without limitation for intent and gross negligence and for injury to life, body or health.

In cases of ordinary negligence we are liable only for breach of a material contractual duty, limited to the foreseeable damage typical of this kind of contract.

Please tell us about allergies and intolerances before a tasting. Milk, nuts and gluten are present in food served at the counter; details are available at the bar at any time.

§ 9 Right of withdrawal

Consumers have a right of withdrawal for vouchers ordered online. Please see the withdrawal notice for details.

For reservations for a specific date there is no right of withdrawal under § 312 g (2) no. 9 BGB; the cancellation rules in § 3 apply.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of your country of habitual residence remain unaffected.

Where the customer is a merchant, a legal person under public law or a special fund under public law, the place of jurisdiction is Hamburg.

Should any provision be invalid, the validity of the remaining provisions is unaffected.
